Purchase Terms & Conditions
These Purchase Terms and Conditions ("Terms") govern the sale of bicycle frames and complete bicycles (collectively referred to as "bicycles") by Apogee Bikes, LLC ("Seller") to the customer ("Buyer"). By purchasing a bicycle from Seller, Buyer agrees to be bound by these Terms.
1. Acceptance of Terms
By placing an order, Buyer agrees to these Terms. Any additional or different terms proposed by Buyer are rejected unless expressly agreed upon in writing by Seller.
2. Order Confirmation
An order is considered confirmed when Buyer receives an order confirmation from Seller. Seller reserves the right to cancel any order prior to shipment.
3. Price and Payment
Price: The price of the bicycle is as stated at the time of purchase. All prices are in USD.
Payment: Payment must be made in full at the time of order unless otherwise agreed in writing. Accepted payment method is exclusively through the webstore unless otherwise agreed in writing.
Taxes and Fees: Buyer is responsible for any applicable taxes, duties, or fees related to the purchase.
4. Shipping and Delivery
Shipping Costs: Shipping costs are the responsibility of Buyer unless otherwise stated.
Delivery Time: Seller will make reasonable efforts to ship the bicycle within the estimated delivery time. However, delivery dates are estimates and not guaranteed.
Risk of Loss: Risk of loss passes to Buyer upon delivery of the bicycle to the carrier.
5. Inspection and Acceptance
Buyer must inspect the bicycle upon delivery and notify Seller of any defects or discrepancies within 15 days. Failure to notify Seller within this period constitutes acceptance of the bicycle. By failing to notify the seller of any issues within the specified 15-day period, the buyer is considered to have accepted the bicycle as-is, meaning that they agree it meets all the required specifications and conditions outlined in the purchase agreement.
6. Warranty
Manufacturer's Warranty: The bicycle is covered by the manufacturer's warranty, if applicable. The terms of this warranty will be provided with the bicycle and can be accessed here.
7. Returns
Return Policy: Bicycles may be returned within 15 days of delivery for a refund or exchange, provided the bicycle is in new, unused condition and in its original packaging. Returns outside of this period may be considered on a case-by-case basis at the discretion of the Seller.
Restocking Fee: A 25% restocking fee will apply to all returns, unless the return is due to an error on the part of the Seller.
Return Process: Buyer must contact Seller to obtain a return authorization before returning the bicycle. Unauthorized returns will not be accepted.
Return Shipping: Buyer is responsible for return shipping costs unless the return is due to an error on the part of Seller.
8. Refunds and Cancellations
Full Refund Period: Buyer may cancel the order within 48 hours of placing it for a full refund.
Cancellation After 48 Hours: After the initial 48-hour period, cancellations will incur a cancellation fee of 25% of the purchase price.
Cancellation Process: To cancel an order, Buyer must contact Seller directly. Orders cannot be canceled once the bicycle has shipped.
9. Limitation of Liability
Seller's liability for any claim arising out of or related to the purchase of the bicycle is limited to the purchase price of the bicycle. Seller is not liable for any indirect, incidental, or consequential damages.
10. Governing Law
These Terms are governed by the laws of Oregon, USA, without regard to its conflict of laws principles. Any disputes arising from these Terms will be resolved in the courts of Oregon, USA.
11. Entire Agreement
These Terms, along with the order confirmation, constitute the entire agreement between Buyer and Seller and supersede any prior agreements or understandings, whether written or oral.
